1. Scope of this Privacy Policy

This Privacy Policy applies to all Empxtrack websites that link to it. It also applies to the products and services provided by Empxtrack through these websites, our mobile applications, and applications posted by Empxtrack on Empxtrack online marketplace and in other third-party online marketplaces.

2.1 What information Empxtrack collects

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

  • Account signup: When you sign up for an account to access one or more of our services, we ask for information like your name, contact number, email address, company name and country to complete the account signup process. You’ll also be required to choose a unique username and a password for accessing the created account. You may also provide us with more information such as your time zone and language.

  • Payment processing : When you buy something from us, we ask you to provide your name, contact information, and credit card information or other payment account information. When you submit your card information, we store the name and address of the cardholder. We do not store the actual credit card number. For quick processing of future payments, if you have given us your approval, Payment Gateway Service Providers may store your credit card information or other payment information in an encrypted format.

  • Information from browsers, devices and servers: When you visit our websites, we collect information that web browsers, mobile devices and servers make available, such as the internet protocol address, browser type, language preference, time zone, referring URL, date and time of access, operating system, mobile device manufacturer and mobile network information. We include these in our log files to understand more about visitors to our websites.

We embed unique identifiers in our downloadable products to track usage of the products.   • Signups using federated authentication service providers : You can log in to Empxtrack Services using supported federated authentication service. These services will authenticate your identity and give you the option to share certain personal information with us, such as your name and email address.
  • Referrals : If someone has referred any of our products or services to you through any of our referral programs, that person may have provided us your name, email address and other personal information. You may contact us at contactdpo@empxtrack.com to request that we remove your information from our database. If you provide us information about another person, or if another person gives us your information, we will only use that information for the specific reason for which it was provided to us.
  • Information from social media sites and other publicly available sources : When you interact or engage with us on social media sites such as Facebook, Twitter, Google+ and Instagram through posts, comments, questions and other interactions, we may collect such publicly available information, including profile information, to allow us to connect with you, improve our products, or better understand user reactions and issues. 3. Purposes for using information

In addition to the purposes mentioned above, we may use your information for the following purposes:

Opt out of non-essential electronic communications : You may opt out of receiving newsletters and other non-essential messages by using the ‘unsubscribe’ function included in all such messages. However, you will continue to receive notices and essential transactional emails.

We do not sell any personal information. Employees of Empxtrack have access to the information on a need-to-know basis. We require all employees having access to personal information to follow this Privacy Policy for personal information that we share with them. Every employee in Empxtrack has signed a data confidentiality agreement at the time of joining Empxtrack.

We don’t share your information with any third party service providers, reselling partners, domain registrars or market place developers

7. Data Security (including GDPR)

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees who have a business need to know. They will only process your personal data on your instructions and are subject to all requirements of confidentiality and safety.

We understand the criticality of business data which gets entered into our system by your employees via different tools offered by us such as goal management, performance appraisals, timesheet,  salary, promotion and increments, recruitment and exit, travel and expenses, rewards and recognition, organization structure and reporting relationship and many other areas related to working of employees in your organization.

We ensure your data is properly managed based on 5 important principles:

All data is replicated to our data centers in real-time and stored in secured SOC2 certified cloud data centers. Because of this, we’re able to guarantee your data will be both safe and available to you wherever and whenever you need it.

All software and hardware assets are continuously audited against unauthorized access and/or hardware faults. 

In addition, empxtrack security performs monthly failover and security audits to ensure system integrity. Third party audits are performed twice annually. 

All data traffic into and out of the network is monitored 24x7x365 with intrusion detection and in case any anomaly is detected notifications are sent to the appropriate professionals. Furthermore, any unauthorized attempts to gain access to resources are immediately blocked after a limited number of unsuccessful attempts.

Through the use of multi-vendor firewalls, two-factor authentication, and intrusion detection, we’re able to protect your data from data breaches and unauthorized access. Our enterprise-level encryption measures guarantee the complete protection and privacy of your company’s data. 

Our employees have access to your data on a need to know basis through controlled and logged access and we have all safeguards in place to ensure your data (and associated reports and analytics) remains safe in storage, access and retrieval.

Each empxtrack employee has a full background check at the time of hiring, signs a non-disclosure agreement and goes through yearly security trainings and safe data handling techniques. The computers used by empxtrack employees have appropriate restrictions, firewalls and anti-virus software to ensure safety and security of your data.

Further, we have multiple mechanisms to control access of employee data by “your” employees. This includes setting spans, setting module and field level and we store audit trails for all data changes.

We have put in place procedures to deal with any suspected data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. Your rights with respect to information we hold about you

Empxtrack is merely processor of information provided by our clients. To exercise your rights such as right to access, right to rectification, right to erasure, right of restriction of processing, right of data portability and right to complain you can reach controller of data which in most cases is your employer through concerned HR. 9. Retention of information

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

We hold the data in your account as long as you choose to use Empxtrack Services. Once you terminate your Empxtrack user account, your data will eventually get deleted from active database during the next clean-up that occurs once in 12 months. The data deleted from active database will be deleted from backups after 12 months post active database cleanup.

10. Children’s personal information

  • Our products and services are not directed to individuals under 16.
  • Empxtrack does not knowingly collect personal information from children who are under 16 years of age.
  • Empxtrack as an HR product allows you to store beneficiary or dependents information. These dependents/beneficiaries can be minor also. You can choose not to give this information, or you can request to get this information deleted by sending an email to your employer.

11. Compliance with this Privacy Policy

We make every effort, including periodic reviews, to ensure that personal information you provide is used in conformity with this Privacy Policy. We may change this Privacy Policy from time to time, and all changes will be effective at the time we post them.
